Assumption of Risk, Waiver, and Release Form

I, the undersigned, hereby acknowledge and agree that I am voluntarily participating in wellness treatments, therapies, and/or spa services (the “Services”) provided by Ayurveda Healing Spa (“the Spa”). I acknowledge and agree to comply with all instructions, both written and stated, during my participation in the Services.

I understand that such Services may include, but are not limited to, Ayurvedic therapies, massages, bodywork, steam treatments, herbal remedies, oils, aromatherapy, yoga, meditation, and related holistic health practices. I acknowledge that such participation carries inherent risks that cannot be eliminated without altering the essential nature of the Services. These risks include, but are not limited to:
(i) physical strain, muscle soreness, skin irritation, allergic reactions, or burns from oils, herbs, or equipment;
(ii) aggravation of pre-existing medical conditions;
(iii) possible malfunction or misuse of equipment;
(iv) negligence of myself or others;
(v) injury, illness, or other adverse effects arising from my own underlying health conditions or the natural outcome of treatments.

I, for myself and on behalf of my successors and assigns, hereby:

1. Waive and Release Ayurveda Healing Spa and its owners, practitioners, therapists, and agents from any and all claims, demands, liabilities, damages, losses, expenses, attorney fees, or causes of action, whether known or unknown, arising out of or in any manner connected with my participation in the Services.

2. Acknowledge and Assume Risks of injury, illness, or adverse effects while receiving or participating in the Services. I understand that Ayurveda Healing Spa has no duty to warn me of specific risks, and that I may withdraw from participation at any time. I further agree to immediately inform the practitioner if I feel unwell, uncomfortable, or sustain any injury during the Services.

3. Release and Hold Harmless Ayurveda Healing Spa and its agents, including its practitioners, therapists, and staff, from any injury, disability, illness, death, loss, or damage to myself or my property, whether arising from negligence, recklessness, or otherwise.

4. Indemnify Ayurveda Healing Spa and its practitioners against any and all claims, damages, demands, or expenses arising out of my participation in the Services.

5. Consent to Use of Likeness. I consent to the Spa’s use of any photographs, videos, or recordings taken of me during my participation in the Services for promotional, marketing, or educational purposes, with or without my name, and waive any right to compensation.

This Assumption of Risk, Waiver, and Release shall be binding to the fullest extent permitted by law. If any provision is held invalid or unenforceable, all remaining provisions shall remain in full force and effect.

I HAVE CAREFULLY READ AND VOLUNTARILY SIGN THIS ASSUMPTION OF RISK, WAIVER, AND RELEASE AND FURTHER AGREE THAT NO ORAL REPRESENTATIONS, STATEMENTS, OR INDUCEMENTS APART FROM THE FOREGOING AGREEMENT HAVE BEEN MADE TO ME. I REPRESENT THAT I AM AT LEAST 18 YEARS OF AGE AND LEGALLY COMPETENT TO EXECUTE THIS AGREEMENT.
