Assumption of Risk, Waiver and Release Form

I, the undersigned, hereby acknowledge and agree that I am voluntarily participating in wellness treatments, therapies, and spa services (the “Services”) provided by Ayurveda Healing Spa (“Ayurveda Healing Spa”). I acknowledge and agree to comply with all instructions, both written and stated, during my participation in the Services. I acknowledge such participation may involve the use of herbal oils, heated stones, steam, massage, aromatherapy, yoga, meditation, and other holistic practices that cannot be conducted without certain inherent risks. I acknowledge that such participation includes, but is not limited to, the risk of (i) physical injury, soreness, or discomfort from treatments and/or equipment utilized; (ii) possible equipment or facility malfunction and/or misuse by myself or others; (iii) negligence in the handling of treatments or negligence of others; (iv) damage to my personal property; and (v) allergic reaction, illness, or in rare cases, more serious health complications.

I, for myself and on behalf of my successors and assigns, hereby:

Waive and release Ayurveda Healing Spa and its agents, therapists, practitioners, and staff from any and all claims, attorneys’ fees, demands, liabilities, damages, losses, expenses, and obligations of every type or character, known or unknown, absolute or contingent, direct or consequential, whether arising at law or in equity, pursuant to contract, tort, statute or otherwise, which I now have or may have in the future arising out of or in any manner connected with the Services.

Agree and acknowledge that I accept and assume all foreseeable and unforeseeable risks of injury, illness, or other adverse effects, including but not limited to the stated above risks, while participating and in connection with participating in the Services. I further agree to immediately cease all participation in the Services in the event I sustain an injury or adverse reaction and immediately make Ayurveda Healing Spa aware of any such issues. I acknowledge I am free to withdraw from participation in the Services at any time. Ayurveda Healing Spa has no duty to warn me of any specific risks, dangers, or hazards.

Release and hold harmless Ayurveda Healing Spa and its agents, therapists, practitioners, and staff from all injury, disability, death, loss, or damage to myself or my property whether by negligence, recklessness, or otherwise.

Will indemnify Ayurveda Healing Spa and its practitioners, therapists, and staff for any claim, actions, demands, injury, disability, loss, or damage arising out of my participation in the Services, whether by negligence, recklessness, or otherwise.

Consent for all purposes to allow for the reproduction and use of any photographs, videos, derivative works, and/or likeness in any form and all manners of me, with or without the use of my name, by Ayurveda Healing Spa and in connection with any media, promotional materials, brochures, websites, or other advertising material. In giving this consent, I release Ayurveda Healing Spa from liability for any violation of any personal and/or proprietary right I may have in connection therewith. I hereby waive any right to compensation from such use of the foregoing.

This assumption of risk, waiver, and release shall be binding to the fullest extent permitted by law. If any provision of this release is found to be invalid or unenforceable, all the remaining terms shall be enforceable.

I, AND MY PARENT OR GUARDIAN, HAVE CAREFULLY READ AND VOLUNTARILY SIGN THIS ASSUMPTION OF RISK, WAIVER, AND RELEASE AND FURTHER AGREE THAT NO ORAL REPRESENTATIONS, STATEMENTS, OR INDUCEMENT APART FROM THE FOREGOING AGREEMENT HAVE BEEN MADE TO US. WE FULLY UNDERSTAND THE TERMS OF THIS AGREEMENT. WE ACKNOWLEDGE THAT ALL PERSONS UNDER THE AGE OF 18 MUST HAVE PARENTAL OR GUARDIAN CONSENT TO PARTICIPATE IN THESE SERVICES.
